TERMS OF SERVICE

To ensure a safe and reliable experience for our customers, EB-GIFT operates in compliance with all applicable laws and regulations.

Please read these Terms of Service carefully before using EB-GIFT.

Section 1: Purpose of the Terms of Service

We have established these Terms of Service (“the Terms”) for the use of our online gift certificate shop, "EB-GIFT" (the "Site"). The Terms outline the conditions of use and important notices for customers using the Site.

Section 2: Scope and Changes to the Terms

We may revise, update, or amend these Terms to reflect changes in laws, regulations, or commonly accepted internet practices.

Any changes to the Terms will be announced on the Site, and the updated Terms will be posted online. From the date of posting, your use of the Site will be governed by the revised Terms.

Section 3: Eligibility

Use of the Site is limited to individuals who meet all of the following requirements:

  • You are at least 20 years old and agree to these Terms of Service
  • You have not been declared bankrupt or received notice of bankruptcy proceedings
  • You are not a member of, nor affiliated with, any organized crime group or other antisocial forces
  • You have a valid email address that can receive messages from us
  • You have a valid phone number through which we can contact you
  • You can provide proof of the above upon our request

Section 4: Prohibited Conduct

When using the Site, you must not engage in any of the following activities. If we become aware of any conduct that violates applicable laws or regulations, we reserve the right to report such activity to the relevant authorities.

  • Providing false or inaccurate information to us
  • Attempting to deceive or defraud us
  • Impersonating our company or any third party
  • Using the Site for purposes other than its intended use
  • Infringing or damaging the rights, property, reputation, credit, or privacy of our company or any third party
  • Copying, altering, or tampering with data on the Site
  • Violating any applicable laws or regulations
  • Engaging in conduct that is contrary to public order and morality
  • Violating generally accepted internet rules or etiquette
  • Any other conduct that deviates from common sense or socially accepted standards

Section 5: Payment Methods

The Site currently accepts payments by credit card.

When you purchase a service through our website, the credit card statement will show the charge under the name "DBA Name".

Section 6: Refusal of Payment

We may refuse to accept payments made by credit card if any of the following apply or are suspected:

  • A credit card held in the name of a third party other than the user (including family cards)
  • A credit card reported as lost or not in the user’s possession
  • A credit card that is forged, altered, or otherwise invalid
  • A credit card used in violation of the terms and conditions of the issuing company
  • A credit card for which the user cannot provide proof of identity upon our request

Section 7: Reservation of Shipment

We may withhold the issuance of coupons by email for transactions falling into the following categories until the related issues are resolved:

  • Transactions with users who have not provided required identification documents or other necessary paperwork
  • Transactions with customers whose receipt of coupons from previous transactions has not been confirmed
  • Transactions with users who are considered to have outstanding payments from previous transactions

Section 8: Formation and Termination of Sales Contracts

1. Formation of the Contract

A sales contract on the Site is deemed to be concluded when both of the following conditions are met:

  • The user makes a payment with the intention to purchase (the "Order")
  • We confirm and accept the user’s Order (the "Acceptance")

2. Our Right to Cancel

We may unilaterally cancel a sales contract in the following cases:

  • The user does not meet the eligibility requirements set forth in Section 3
  • The user engages in prohibited conduct as set forth in Section 4
  • The user attempts to pay with a credit card described in Section 6

3. User’s Right to Cancel

A user may request to cancel a sales contract by submitting the necessary documents specified by us if any of the following apply:

  • A return or refund is necessary
  • The product received differs from the product ordered

4. Refusal of Cancellation

We may refuse a cancellation request from the user if any of the following apply:

  • More than 4 days have passed since the delivery date
  • The product or packaging is missing parts or differs from the original shipment
  • The order was received by someone other than the designated recipient
  • False or inaccurate information was provided at the time of the order

Section 9: Measures Against Unauthorized Gains

If we determine, or have reason to suspect, that a user has obtained benefits that rightfully belong to us, we may request confirmation and restitution of such improper gains. If the user fails to comply with such a request, we reserve the right to pursue legal action against the user.

Section 10: Transfer of Ownership

Ownership of a product transfers to the user on the date the purchase price is paid in full.

Section 11: Suspension of the Site

We may suspend the operation of the Site without prior notice if we determine that it is difficult to continue normal operations due to any of the following events. We will notify users by email of the expected resumption date within 7 days of the suspension.

  • Natural disasters or man-made disasters
  • Political upheaval or other significant social events
  • Failures of essential infrastructure (such as electricity, communication, or transportation services)

Section 12: Disclaimer

We make every effort to ensure the accuracy of the information posted on the Site and to fulfill sales contracts with users. However, we do not guarantee that such information will always be accurate or that all transactions will be successfully completed.

Section 13: Limitation of Liability and Damages

If a user suffers damages as a result of intentional misconduct or gross negligence attributable to us in connection with the use of the Site, our liability shall be limited to a maximum of 100,000 yen.

Furthermore, if we suffer damages due to a user’s prohibited conduct as defined in Section 4, we may pursue legal action and claim compensation from the user.

Section 14: Governing Law and Jurisdiction

In the event of any dispute between the user and us, the courts of Hong Kong shall have exclusive jurisdiction as the court of first instance.
